In a meeting held behind closed doors on Oct. 22, the City Council turned down the claim by a vote of 6-0 to 1. Pedro Rivera De Leon was charged with illegal child abuse in 2022 after his son Ayden Rivera Gonzalez drowned in the pool at his apartment complex.
The claim says that in August of last year, the Superior Court of Santa Clara County dropped all of Rivera’s charges. The people being sued are city officials and police cops.
It says that the person was wrongfully prosecuted, wrongfully arrested and jailed, intentionally caused emotional pain, abused the legal system, was battered, and was maliciously prosecuted.
The book also talks about other types of harm, such as pain and suffering, losing a reputation, losing money, being scared and nervous, and losing friends.
Rivera has already had a claim against the city. In September 2022, both Rivera and the boy’s mother filed a claim for wrongful killing. They asked for $7.6 million in damages for things like mental suffering. The city said no to both claims at the time.
